PACK, Fred

Police Chief Hugh Maddy, 46, in a brief appearance before County Judge L. F. Wellman Monday waived to the grand jury on a charge of wilful murder in the slaying of Fred Pack, his assistant, and was released on $12,000 bond which was signed by a number of prominent residents of the county. Pack was killed instantly shortly after 12:30 noon last Thursday by several bullets as he entered a doorway leading to the kitchen of the Hamburger Inn. Five out of six bullets fired by Maddy entered Pack's body. Maddy surrendered immediately to Sheriff Proctor Fyffe and was taken to the county jail by E. T. Webb, deputy sheriff, where he remained until his release. At a coroner's jury inquest held Friday, with Coroner Henry Young presiding, only 2 witnesses to the shooting were heard and each gave a different version.

Charles Hanners of the Point section who was having lunch at the Inn at the time of the shooting, told the jury that Pack and Maddy had been talking a short time in the kitchen. Pack then went outside the Inn for a few minutes and upon returning, drew a cup of coffee from the coffee urn. After he had drunk the coffee he started into the kitchen. The next moment Hanners heard the shots. He testified that Pack's hands were free at his sides as he entered the kitchen.  Mrs. Vivian Adams, the other witness and an employee of the Inn, stated that Pack and Maddy had talked in the kitchen while Maddy was eating his lunch. She testified that Pack had made two trips to the kitchen to the water cooler and  on the last trip she heard Maddy ask Pack, "Fred, let's forget all this". She quoted Pack as saying "No." adding that one of them would go out of office when the city council met Thursday night.

Pack according to Mrs. Adams, then went into the dining room of the Inn and Maddy told one of the waitresses to call Mayor Britton. there was considerable noise in the Inn so Mrs. Adams began to close the door between the dining room and the kitchen just as Pack started into the kitchen. Mrs. Adams testified that as pack approached the door, he reached for his pocket where upon Maddy fired the fatal shots. The jury was composed of E. C. Skaggs, George Al Thompson, Om Wilson, Raish Blankenship, Bax Shortridge and

Clyde Moore. Commonwealth's Attorney Tom Burchett and County Attorney W. D. Sparks have employed Eldred E. Adams of Louisa as a special assistant for the  prosecution if Maddy is indicted by the June grand jury. C. F. See and K. C. Elswick will defend Maddy.

BURNS, Rolland T.

Motor Machinist Mate 1-c Rolland T. Burns, son of Mr. and Mrs. Charles Burns of Buchanan, was reported "missing in action" by the U. S. Navy officials in November, 1944, and whose death was confirmed by the Navy in December 1945. Announcement of the message confirming Burns' death has been withheld since December because of illness in the family. Burns lost his life as a member of the crew on the U. S. Submarine,
"Shark, 2nd", which was sunk by Japanese aircraft in October 1944. The following information concerning the loss of the "Shark, 2nd" has been forwarded to Burns' family by Navy officials.

"Joining the Seadragon and Blackfish at Pearl Harbor, the Second Shark left that place on 23 September 1944 and proceeded to Saipan. The three vessels left the latter island on October, to conduct coordinated patrol in the vicinity of Luzon Strait. Commander Blakely had command of this coordinated attack group. On October the Shark reported having contacted 4 large enemy vessels. She still had her full load of torpedoes aboard, but had not made an attack. The Shark addressed further message to bases, but on October 24, the Seadragon received a message from her stating that she had made radar contact with a single freighter, and that she was going to attack. This was the last message received from the Shark, However, on 13 November 1944, a dispatch originated by Commander Naval Unit, Fourteenth Air Force, stated that a Japanese ship was en route from Manila to Japan with 1800 American prisoners of war had been sunk on 24 October 1944 by an American submarine in a torpedo attack, since the Shark had given the Seadragon a contact report only a few hours before the sinking, and could not be raised by radio after it, it can only be assumed that the Shark made the attack described and perished during or after it. On the Shark's first patrol she had been credited with sinking 4 ships totaling 32, 200 tons and damaging one ship of 4,300 tons and rescued 2 aviators. Machinist Mate Burns entered the service in February 1940, and had received the Navy's "3-Star Citation''. He is survived by his parents, 2 brothers, Wallace and Douglas Burns of Buchanan and 2 sisters, Mrs. Hal Smith, Jr. and Mrs. Alec Fry both of Catlettsburg. Big Sandy News, Aug 16, 1946
